These Terms of Service ("Terms") govern your access to and use of the NewSiteLead website, APIs, diagnostic reports, and all related services (collectively, the "Service") operated by NewSiteLead ("we," "us," or "our"), located at 25422 Trabuco Rd STE 184, Lake Forest, CA 92630. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
NewSiteLead provides domain intelligence and business analysis services, including:
- Domain Discovery: Monitoring internet data sources to identify newly launched websites, with web-based search, filtering, and browsing of over one million domains.
- Data Export: CSV download of domain data, subject to your subscription plan limits.
- API Access: Programmatic access to domain data for Pro and Enterprise subscribers.
- Biz Intelligence Diagnostics: On-demand, AI-generated business analysis reports purchased per question ("Diagnostic Reports").
- Blog Content: Editorially curated and AI-assisted blog articles about newly registered domains and industry trends.
- Cross-Platform Integrations: Domain detail pages may display results from affiliated services including WCAG Repair (accessibility audits), Abbyseo (SEO audits), AI-Signed (e-signature verification), and SiteDialect (multilingual audits). These integrations are provided for informational purposes and are governed by the respective service's own terms.
2. Accounts and Registration
To access certain features, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to refuse registration or cancel accounts at our discretion.
You represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Subscription Plans and Billing
- Starter ($29/month): 25 domain detail views per day, 1 CSV export per day, domain metadata access.
- Pro ($79/month): Unlimited detail views and exports, API access, up to 5 saved searches, up to 5 alerts.
- Enterprise ($199/month): All Pro features plus webhooks, real-time alerts, and priority support.
All subscriptions are billed monthly through Stripe, Inc. You may cancel at any time; your access continues through the end of the current billing period. Refunds are not provided for partial billing periods. See our Refund Policy for full details. We reserve the right to change pricing with 30 days' notice to active subscribers. Continued use after a price change constitutes acceptance of the new pricing.
4. Diagnostic Reports (Biz Intelligence)
Diagnostic Reports are one-time purchases at $5.00 per question. By purchasing a Diagnostic Report, you acknowledge and agree that:
- AI-Generated Content: Reports are generated by artificial intelligence (Anthropic's Claude) based on publicly available information about the domain you specify, combined with any optional business context you provide at checkout. Reports reflect AI analysis and should not be treated as professional consulting, legal, financial, or accounting advice.
- No Guarantee of Accuracy: While we strive for useful, actionable output, AI-generated reports may contain inaccuracies, incomplete analysis, or outdated information. You are responsible for independently verifying any findings before making business decisions.
- Report Retention: Diagnostic Reports are retained for 200 days from the date of generation, after which they are permanently and automatically deleted. You are responsible for downloading or saving any reports you wish to keep beyond this period.
- No Refunds: Because reports are generated immediately upon payment, all Diagnostic Report purchases are final. If a report fails to generate due to a technical error, we will re-attempt generation or issue a refund at our discretion.
- Business Context Data: Any business context notes you provide during checkout are used solely to improve report relevance. This data is processed by our AI provider (Anthropic) and is subject to Anthropic's data handling practices as described in our Privacy Policy.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, including spam, phishing, harassment, or stalking
- Attempt to scrape, crawl, or systematically download data beyond the limits of your subscription plan
- Share, resell, or redistribute API keys, account credentials, or Diagnostic Reports to unauthorized third parties
- Interfere with the operation of the Service, circumvent rate limits, or bypass access controls
- Use data obtained through the Service to send unsolicited communications in violation of applicable law, including CAN-SPAM, GDPR, CASL, or similar regulations
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Use automated tools (bots, scrapers, browser automation) to access the Service except through our documented API
- Submit false, misleading, or fraudulent information during account registration or diagnostic checkout
- Use Diagnostic Reports to defame, harass, or harm the subjects of those reports
- Attempt to probe, scan, or test the vulnerability of the Service or circumvent security measures
Violation of these terms may result in immediate account suspension or termination without refund.
6. API Usage
API access is available on Pro and Enterprise plans. API keys are confidential and must not be shared or embedded in client-side code. We reserve the right to revoke API keys that are misused, shared, or that generate excessive load. API responses are subject to the rate limits and quotas defined by your plan. We may impose additional rate limits to maintain service stability.
You may not use our API to build a competing service or to systematically replicate our database. API data may be cached locally for reasonable operational purposes but must not be redistributed as a standalone dataset.
7. Intellectual Property
Our Content
The Service, including its design, code, logos, documentation, and original content, is the intellectual property of NewSiteLead and is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our proprietary materials without written permission.
Domain Data
Domain data provided through our Service is derived from publicly available internet data sources. You may use exported data for your internal business purposes in accordance with your subscription plan. You may not resell or sublicense raw domain data as a standalone product.
Diagnostic Reports
Upon purchase, you receive a non-exclusive, non-transferable license to use your Diagnostic Reports for your internal business purposes. You may share reports with your own advisors, partners, or team members. You may not resell reports, publish them publicly without attribution, or use them to build derivative data products.

8. Third-Party Services and Cross-Sell Integrations
Our domain detail pages display scan results and links from affiliated services including WCAG Repair, Abbyseo, AI-Signed, and SiteDialect. These are separate services operated under their own terms of service and privacy policies. NewSiteLead is not responsible for the accuracy, availability, or practices of these third-party services. Clicking through to or purchasing from these services constitutes a separate transaction governed by their respective terms.
Payment processing is provided by Stripe, Inc. and is subject to Stripe's Terms of Service.
9. AI-Generated Content Disclaimer
Portions of our Service, including Diagnostic Reports and blog articles, are generated or assisted by artificial intelligence. AI-generated content is provided "as is" and may contain errors, omissions, or reflect outdated information. We do not guarantee that AI-generated content is accurate, complete, current, or suitable for any particular purpose. You should not rely on AI-generated content as a substitute for professional advice in legal, financial, medical, or other specialized domains.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEWSITELEAD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE, RELIANCE ON AI-GENERATED CONTENT, OR ANY THIRD-PARTY INTEGRATIONS.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
12. Indemnification
You agree to indemnify, defend, and hold harmless NewSiteLead and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content or data you provide through the Service, including business context notes submitted for Diagnostic Reports.
13. Termination
We may suspend or terminate your access to the Service at any time for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users or our business interests. Upon termination:
- Your right to use the Service ceases immediately
- Active subscription billing will be canceled (no refund for the current period)
- API keys associated with your account will be deactivated
- Diagnostic Reports will remain accessible until their 200-day retention period expires
- We may retain your data as required by law or as described in our Privacy Policy
You may delete your account at any time through the account dashboard. Account deletion is permanent and cannot be reversed.
14. Dispute Resolution
In the event of a dispute arising from or relating to these Terms or the Service, you agree to first attempt resolution by contacting us at contact@newsitelead.com. If a dispute cannot be resolved informally within 30 days, either party may pursue binding arbitration administered by JAMS under its Streamlined Arbitration Rules in Orange County, California. The arbitrator's decision shall be final and binding. Each party bears its own costs unless the arbitrator determines otherwise.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.
Small Claims Exception: Either party may bring a claim in small claims court in Orange County, California, if the claim qualifies.
15. Force Majeure
NewSiteLead shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, power outages, internet service disruptions, or third-party service provider failures.
16. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated by posting updated Terms on this page and, for active subscribers, by email notification at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Service and cancel your subscription.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and Data Processing Agreement, constitute the entire agreement between you and NewSiteLead regarding the Service and supersede any prior agreements.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
